LightVerify.com provides SMS verification services for businesses and individuals. Our Service allows users to verify phone numbers through SMS messages containing verification codes.

User Registration and Account Security

3.1. To use certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

3.2. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

3.3. You must immediately notify LightVerify.com of any unauthorized use of your account or any other breach of security.

Use of the Service

4.1. You agree to use the Service only for lawful purposes and in accordance with these Terms.

4.2. You shall not:

• a) Use the Service for any illegal or unauthorized purpose.
• b) Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.
• c) Interfere with or disrupt the Service or servers or networks connected to the Service.
• d) Violate any applicable laws or regulations.
• e) Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
• f) Use the Service for sending unsolicited communications, promotions, advertisements, or spam.
• g) Use the Service to harass, abuse, or harm another person or entity.
• h) Use the Service in any way that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.

4.3. Prohibition of Spam: We strictly prohibit the use of our Service for any form of spam or unsolicited bulk communications. This includes, but is not limited to:

• a) Sending marketing messages to individuals who have not explicitly opted in to receive such communications.
• b) Using our verification service to validate phone numbers for the purpose of creating contact lists for bulk messaging.
• c) Utilizing our Service in conjunction with any automated messaging system designed for bulk communications.

4.4. Violation of these anti-spam provisions may result in immediate termination of your account and may subject you to legal action and financial penalties.

4.5. LightVerify.com reserves the right to monitor usage patterns and investigate any suspected violations of these Terms, including the anti-spam provisions.

API Usage and Rate Limiting

5.1. If you use our API, you agree to comply with our API documentation and any rate limits we impose.

5.2. We reserve the right to modify, limit, or discontinue API access at any time without notice.

Fees and Payment

6.1. Certain aspects of the Service may be provided for a fee. You agree to pay all fees associated with your use of the Service.

6.2. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.

6.3. We reserve the right to change our fees at any time upon notice to you.

Intellectual Property Rights

7.1. The Service and its original content, features, and functionality are and will remain the exclusive property of LightVerify.com and its licensors.

7.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purposes.

Privacy and Data Protection

9.1. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9.2. You agree that LightVerify.com may process your personal data in accordance with the Privacy Policy and for the purposes of providing and improving the Service.

Third-Party Services

10.1. The Service may contain links to third-party websites or services that are not owned or controlled by LightVerify.com.

10.2. LightVerify.com has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services.

Disclaimer of Warranties

11.1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.

11.2. LightVerify.com does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

12.1. To the maximum extent permitted by law, LightVerify.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

12.2. In no event shall LightVerify.com's total liability to you for all damages exceed the amount you paid to LightVerify.com, if any, in the past twelve months.

Indemnification

You agree to indemnify and hold harmless LightVerify.com and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service.

Termination

14.1. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

14.2. Upon termination, your right to use the Service will immediately cease.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page and updating the "Last Updated" date.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and LightVerify.com regarding the Service and supersede all prior agreements and understandings, whether written or oral.

SMS Terms and Conditions

20.1. These Terms ONLY APPLY TO text messaging OPT-INS: LightVerify.com text messaging program: Our SMS campaign will inform subscribers regarding marketing, customer care and account notifications. Message frequency: message frequency varies.

20.2. Opt-out instructions: Reply STOP to end. You will then be unsubscribed from LightVerify.com and no further messages will be delivered.

20.3. Carriers are not liable for delayed or undelivered messages. Message and data rates may apply. Mobile subscribers' phone numbers will NEVER be shared or sold to third parties.

20.4. By participating in the Service, you agree to these Terms and Conditions and the Privacy Policy.

Signing Up and Opting-In to the Service

20.5. Enrollment in the Service requires you to provide your mobile phone number and agree to these terms and conditions. Note that you may not enroll if you are under 18 years old.

20.6. Before the Service starts, you will need to agree to these Terms. LightVerify.com reserves the right to stop offering the Service at any time, with or without notice.

20.7. By opting into the Service, you:

• Acknowledge that you do not have to agree to receive messages as a condition of purchase.
• Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.
• Consent to the use of an electronic record to document your opt-in. To request a free paper or email copy of the opt-in or update our records with your contact information, contact us at Support@lightverify.com.

20.8. To view and retain an electronic copy of these Terms or the rest of your opt-in, you will need (i) a device (such as a computer or mobile phone) with Internet access and (ii) either a printer or storage space on such device. For an email copy, you will also need an email account you can access from the device, along with a browser or other software that can display the emails.

Message Frequency

20.9. Once you affirm your choice to opt in to the Service, your message frequency may vary.

Charges and Carriers

20.10. Message and data rates may apply. Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data, or other costs incurred (usage, subscription, etc.) as a result of using the Service.

20.11. The Service may not be available on all wireless carriers. LightVerify.com may add or remove any wireless carrier from the Service at any time without notice. LightVerify.com and mobile carriers are not responsible for any undue delays, delivery failure, or errors in messages.

To Stop the Service

20.12. To stop receiving text messages from LightVerify.com, text the word STOP to any of the text messages you have received. This is the exclusive method for opting out. For Services operated through a different number, text STOP to that number to opt out. Your opt-out request may generate either a confirmation text or a text request to clarify the text message program it applies (if you have more than one). To complete your opt-out, please provide the requested clarification.

20.13. You acknowledge that the text message platform may not recognize and respond to unsubscribe requests that do not include the STOP keyword command and agree that LightVerify.com and its service providers will have no liability for failing to honor such requests. In addition, if you unsubscribe from one of our text message programs, you may continue to receive text messages from LightVerify.com through any other programs you have joined until you separately unsubscribe from those programs. These Terms still will apply if you withdraw the consent mentioned above or opt out of the Service.
